All Proposals made and entered into between XTIUM and/or its affiliate or subsidiaries, as applicable (“XTIUM”), with offices at 4025 Tampa Road Suite 1101 Oldsmar, FL 34677 (“XTIUM”), and the Customer are subject to and incorporate the terms of the applicable master services agreement previously executed between the parties, or if no such master services agreement, then the terms and conditions set forth at MASTER SERVICES AGREEMENT. Any third-party manufactured hardware, device, or products set forth in the Proposals are subject to the manufacturer’s terms.
